How to check a Comal County floodplain before building

For residents building in unincorporated Comal County, the first step is a floodplain determination through the County Engineer’s Office at 195 David Jonas Drive, New Braunfels, with a $40 application fee.

To request Comal County’s floodplain determination before building, submit a Floodplain Development Permit Application to the County Engineer’s Office with the required drawing, ownership proof and $40 fee.

The county uses the submitted information to determine whether the proposed structures are within a special flood hazard area. The fee pays for the application; submitting it does not itself establish that construction may proceed.

For property owners in unincorporated Comal County, the county’s determination establishes whether the proposed development must meet its flood damage prevention requirements. The county says its building permit guidance applies to unincorporated areas and cautions that municipalities and other entities may impose additional requirements. If a property is inside a city, check that city’s rules for the proposed work as well.

Gather the application materials

The county’s floodplain page lists four items for the application. The drawing must be to scale and show property lines, existing structures and proposed structures, with the structures tied to the property lines. For ownership proof, the county gives a warranty deed or release of lien as examples of recorded documents.

The county’s Floodplain page supplies this checklist.

Check whether a septic application is part of the project

The route depends on whether the development is associated with an on-site sewage facility, or OSSF, application. For a project with an OSSF application, the Engineer’s Office reviews the associated development for floodplain status. If it determines that development is within the regulatory floodplain, a Floodplain Development Permit is required. For proposed development without an OSSF application, the county says the owner obtains its floodplain development determination by submitting the floodplain application.

An OSSF applicant also submits a design from a registered engineer or sanitarian, according to the county’s permits page. The OSSF and floodplain reviews address different requirements; an OSSF filing does not remove the need for a Floodplain Development Permit when the Engineer’s Office finds that the associated development is in the regulatory floodplain.

Submit the application and wait for the determination

The county accepts applications through its online permit portal or at the Engineer’s Office. For online filing, download the forms for the permit type, complete them and upload them with the required information and fee. The county says a floodplain permit can be processed at the office in a single visit if all required information is submitted. That describes the application process, not a promise that every proposal will qualify to build.

If the county finds the proposal is within the special flood hazard area, the owner must comply with the Comal County Flood Damage Prevention Order to build. The Engineer’s Office also says it reviews compliance with county subdivision regulations as part of the floodplain determination. The next question for an individual project is which additional requirements apply after that finding; the Engineer’s Office can address it using the proposed plans and property information.

To start, use the county’s Floodplain page for the application and checklist, or visit the Comal County Engineer’s Office at 195 David Jonas Drive, New Braunfels. The office lists hours of Monday through Friday, 8 a.m. to 4:30 p.m., and a phone number of 830-608-2090. Ask the office to confirm how its floodplain determination applies to the specific proposal before relying on a map or beginning work.
