For Comal County residents, the public record shows that an engineering site observation and a separate conservation-district field review supported acceptance of the repairs.
Before the vote, Kimley-Horn said its Aug. 11 site observation evaluated the completed improvements for general conformance with approved construction documents and county requirements, and it recommended acceptance subject to the county’s independent determination.
Two reviews preceded acceptance
The Comal-Guadalupe Soil and Water Conservation District said its technician and the Natural Resources Conservation Service district conservationist reviewed the Vogel Dam repairs in the field and found the work acceptable.
Kimley-Horn’s notice says its recommendation was not a warranty of the contractor’s performance. It did not accept defective work discovered after final inspection or relieve the contractor of obligations that survive under off-site improvement bond No. 30254162.
From proposal to outcome
The Sept. 10 agenda identified acceptance of the improvements and release of the surety as proposed Item 11 business. The later recording review establishes the approved outcome, advancing the proposal covered in Comal.News’ meeting guide.
The next records to inspect
Kimley-Horn said it enclosed record as-built drawings, a pre-construction site-observation report and compaction test, and a post-construction observation report and density test; those are the next accountability records to inspect.
Those project records, together with the surety instrument and payment documents, should be checked to determine what led to the repairs, who bore the cost and which obligations continue after release.
