Council voted to postpone the item until October 26. The official meeting recording establishes the new date for the Sun Retreats Texas Hill Country rezoning request.
The rezoning request will determine whether 10 manufactured homes already placed at 141 Rueckle Road may remain or must be removed. The city agenda packet says approval would legalize the homes and allow permitting to continue, while denial would require their removal.
The Planning Commission recommended allowing no more than three manufactured homes at the site on a 5-4 vote. Comal.News covered that narrower recommendation before the council hearing.
How the permit problem developed
The staff report says the property previously had 10 manufactured homes in its southwest section. The applicant told the city those older, deteriorating units were removed in March 2025. City zoning rules allow a legal nonconforming use to continue, but the report cites a 12-month limit after a use or structure ceases, is discontinued or is abandoned.
According to the packet, the applicant met with city staff at a predevelopment meeting in December 2025. The report says that meeting covered the building-permit process but did not address the manufactured homes' legal nonconforming status or their removal from the property.
The owner began installing units and filing building-permit applications in April and May 2026. The city issued three permits, then identified the zoning conflict while reviewing later applications. The building official revoked those permits July 1 and notified the applicant that manufactured homes were not allowed under the property's C-3 zoning.
What remains on the table
The draft ordinance would cap the site at 10 manufactured homes, require fencing along street frontage and apply the city's manufactured-home community standards. Those are proposed conditions, not adopted rules for this property.
The posted proposal covers about 11.44 acres at 141 Rueckle Road, roughly a quarter-mile south of Interstate 35. It would add a special-use overlay to the existing C-3 commercial zoning for manufactured homes.
