New Braunfels City Council is scheduled to decide Sept. 14 whether to authorize eminent-domain proceedings for a 0.7402-acre permanent utility easement at 470 Rio Drive if negotiations do not secure it.
The proposed easement covers the land NBU says it needs to replace the Rio Bar Screen facilities serving the North Kuehler sewer shed and address odor, operational and capacity needs. The project scope includes demolition of the existing bar-screen facility and construction of a new structure, mechanical and manual screens, odor controls, yard piping and related equipment.
NBU’s board adopted Resolution R-2026-221 on Aug. 27 recommending acquisition by purchase or eminent domain. The city item report makes NBU responsible for acquisition costs and any eminent-domain proceedings. The permanent easement would encompass all of Lot 8, Block 4 in the Villa Rio resubdivision, which the resolution identifies as property of the Villa Rio Subdivision Recreation Committee, operated by the Spanish Colony Property Owners Association.
The council meeting begins at 6 p.m. Monday, Sept. 14, in the council chambers at City Hall, 550 Landa St. The Sept. 14 agenda says residents may speak when the item is called. Approval would authorize the acquisition process if negotiations fail; the recorded vote and any later acquisition agreement or court filing will establish what happens next.
