Comal County commissioners will consider taking Simmons Valley Unit 1 roads and drainage into the county maintenance system and releasing two letters of credit.
The two letters of credit carry a combined value of $4,585,833.99: $785,851.22 for work outside the right of way and $3,799,982.77 for work inside it.
Item 7 is still a proposal. The court is being asked to accept the completed road and stormwater work, add the roads to the county system, release letters FTFC-24486 and FTFC-24487, and direct the county engineer to execute right-of-way permit No. 109595.
Why engineers recommend acceptance
Pape-Dawson Engineers said a Sept. 15 visual inspection found the public street and drainage improvements conformed to the approved plans and specifications, with no visible deficiencies or discrepancies brought to the engineer’s attention.
The county engineer’s letter says material-test reports and field inspections indicated the work substantially followed county regulations. It also says record drawings and the design engineer’s completion letter were received and subdivision signage was installed.
If approved, Comal County would become responsible for maintaining the accepted roads, while private landscaping, irrigation and utilities in the right of way would remain governed through permit No. 109595.
The packet identifies Lennar Homes of Texas Land and Construction as the developer and First Texas Fidelity Company as the issuer of both letters of credit. The documents had extended both sureties through July 23, 2027, before the acceptance proposal reached the court.
What happens Oct. 1
Commissioners Court is scheduled to take up the proposal at 8:30 a.m. Oct. 1 at 100 Main Plaza in New Braunfels; approval has not yet occurred.
Residents can inspect the Oct. 1 agenda for the scheduled action and the county engineer’s recommendation for the inspection findings, maintenance consequence and permit details. The vote record will establish whether the roads and drainage were accepted and the sureties released.
