The court approved an interlocal agreement with Kerr County for contingent inmate housing at the Kerr County Detention Center and authorized the county judge to sign.
Comal County may send eligible inmates to Kerrville at $100 per person per day, while Comal pays transportation and nonroutine medical costs.
The Sept. 24 agenda placed the agreement before Commissioners Court as action item 12. The verified recording review establishes approval; the agreement supplies the operating and financial terms.
A fallback with limits
The agreement runs from Oct. 1, 2026, through Sept. 30, 2027, and renews for additional one-year periods unless either county gives notice or the parties change its terms.
Kerr County may accept inmates who are at least 17, in good general health and eligible under the agreement’s classification rules. Kerr’s sheriff retains authority to refuse an inmate or require Comal County to retake custody when capacity, classification, behavior, medical condition or safety creates a problem.
Comal County is solely responsible for transporting inmates between the two county jails and for taking them to Comal County court proceedings or the state prison system. Kerr County would transport inmates to local off-site medical care and bill Comal for that service. Guard service for off-site medical care costs $35 per guard per hour, with at least two guards per transport.
The daily rate includes housing, food, basic custody and routine on-site medical services. Comal County must reimburse prescription, hospital, surgical, dental, optical and other specified care outside that basic coverage.
The next public records
If Comal uses the agreement, Kerr County must submit a monthly itemized invoice and Comal must pay within 30 days.
The operational question is what circumstance would cause the sheriff’s office to use the Kerr County option. A signed copy, transfer record or first invoice would show whether the contingency moved from authorization to actual use and begin to establish its public cost.
