The Texas Comptroller says future contractors and grantees must certify that they do not require customers to show COVID-19 vaccination or recovery documentation to enter or receive service. The agency’s Oct. 21 announcement says it will add the certification to future solicitations and agreements.
A Comal County business seeking a future Comptroller contract or grant would face that certification requirement, and its customers would be covered by the certified access policy. The announcement describes terms for agreements administered by the Comptroller; it does not announce a new certification for every Texas public contract.

These requirements will be standard terms in future contracts and grants administered by the Texas Comptroller of Public Accounts.Texas Comptroller of Public Accounts ↗
The Comptroller says applicants must certify compliance with Section 161.0085 of the Texas Health and Safety Code throughout the agreement, acknowledge that demanding the documents makes a business ineligible for a state-funded contract or grant, and agree to terms giving the agency authority to terminate an agreement immediately. The agency says Texas law already restricts businesses that impose such demands from receiving state-funded contracts or grants.
The next documents to inspect are the Comptroller’s future solicitations and agreements, where the agency says it will place the certification. The announcement does not give a date for the first solicitation using the new language or say whether any existing agreement will be amended; the posted terms will establish its precise application.
