Comal County commissioners are scheduled to decide Oct. 29 whether to take the public roads at The Preserve at Elm Creek Unit 2 into the county Unit Road System for maintenance.

The proposal appears as item 4 on the Commissioners Court agenda for the Precinct 1 subdivision. The item also addresses acceptance of completed road and drainage improvements. The agenda establishes a scheduled decision, not an approved transfer.

For drivers and nearby residents, approval would put the subdivision's public roads under county maintenance. That is the practical change the court is being asked to make: responsibility for maintaining those public roads would move to the county road system if commissioners approve the item. The posted proposal concerns this unit of the development; it does not establish a countywide road-policy change.

Why the engineer recommends acceptance

Assistant county engineer David Vollbrecht wrote on Oct. 19 that he inspected the site, received material tests and as-built plans, coordinated with New Braunfels, and received the city's certification of completion. Those are the steps he cited in recommending county acceptance for road maintenance. His letter supplies the engineering basis for the proposal; it is not a Commissioners Court order.

Vollbrecht wrote that no surety was presented for this unit. His statement is specific to Unit 2 and does not, by itself, describe the financing or guarantees for other parts of the development. The court's scheduled action is acceptance of improvements and public roads; the engineer's recommendation alone does not place them in the county system.

What happens next

Commissioners Court is scheduled to meet at 8:30 a.m. Oct. 29 in the Commissioners Courtroom, 100 Main Plaza, New Braunfels. The court can act on the proposed acceptance at that meeting. The resulting minutes or order will be the record to check for the disposition and any terms attached to it.

Residents can inspect item 4 in the posted agenda to see the proposed action and the engineer's letter for the completion and inspection account. After the meeting, the court's recorded action should establish whether the county accepted the roads. The recorded plat, city completion certification and county road inventory are the next public records to check for the precise road limits and maintenance scope.
