Highway 46 office rezoning and two rentals advance to New Braunfels City Council

Residents near three properties now face the next decision on an office rezoning and two proposed short-term rentals; the commission recommended approval, but City Council has the final say.

The Planning Commission recommended that City Council approve rezoning about 2.6 acres at 1283 State Highway 46 South (case PZ 26-0302) from R-2 and APD to C-O commercial office, keeping the airport hazard overlay.

Before the Oct. 7 meeting, the posted agenda listed the 1283 State Highway 46 South rezoning as a proposal for a public hearing and recommendation. The commission's recommendation advances the requested zoning change to City Council; it does not change the property's zoning by itself.

For nearby residents, the Highway 46 recommendation concerns whether an existing property may shift to commercial office use. The request concerns the existing home as a professional services and counseling office, according to the retained outcome account. The airport hazard overlay would remain under the recommended zoning. Residents weighing the change can compare the proposed designation with the property materials in the city's agenda packet.

Two rental permits recommended

The Planning Commission recommended that City Council approve a special use permit allowing a short-term rental at 242 East Austin Street (case SUP 26-287, about 0.16 of an acre zoned C-1). Jeremy Coburn requested the permit. The reviewed outcome lists a 7-0 recommendation; Council approval is still required for the proposed permit.

The Planning Commission recommended that City Council approve a special use permit allowing a short-term rental at 1064 Comal Avenue (case SUP 26-313, about 0.21 of an acre zoned C-3). The reviewed outcome lists an 8-0 recommendation. Both rental requests concern specific properties; a commission recommendation does not itself authorize either rental.

Fieldcrest remains a question for the next record

The posted agenda listed the 1330 Fieldcrest short-term-rental proposal. Its public-hearing item, SUP26-266, sought a recommendation on a proposed R-1 to C-O special-use-permit change for roughly 0.32 acre. The retained verified outcome records establish actions on the Highway 46, East Austin Street and Comal Avenue requests, but do not establish a disposition for Fieldcrest. A later official action record is needed before reporting a recommendation or vote on that property.

Citizen comments

The agenda provided a general Citizens' Communications period and public hearings for the four property requests. The retained Oct. 7 material includes the posted agenda and four motion-specific verified outcomes, but no reviewed account of general comments, hearing testimony, residents' concerns or recorded official responses. The September 1 draft minutes in the packet concern an earlier meeting and cannot answer who spoke on Oct. 7. The official recording is the next source to review for those portions of the meeting; the present record does not establish that no one spoke.

Meeting record and next decision

The Planning Commission approved the minutes of its previous meeting as written. That routine action concerned the September 1 record, not a fresh decision on any October property request. The posted meeting was scheduled for October 7 at 6 p.m. at City Hall Council Chambers, 550 Landa Street.

The next public record to check is a City Council agenda or action record for the three recommended property requests. Residents can use the city's agenda packet to inspect the proposal materials and the official recording to verify the commission's actions while awaiting Council's decisions and a complete account of the public hearings.
