Comal County commissioners unanimously approved starting the road-acceptance process for the private middle section of Johnson Way on Sept. 3; the vote did not itself accept the road for county maintenance.
County Engineer Boyd estimated $175,000 in repairs for the private middle section of Johnson Way. The approved minutes describe a first step toward a decision that could change who maintains this stretch of road.
Why the county is taking up the road
Boyd described Johnson Way’s middle section as private and said a surety dating to 2014 was missing. He gave commissioners the county road department’s repair estimate rather than presenting the road as ready for immediate county maintenance. The developer’s attached work description lists paving, curbs and flumes. Those are the improvements identified in the request, not a finding that the county has completed or accepted them.
A payment offer tied to acceptance
In a July 10 request, DHJB asked the county to accept the road and offered $175,000 payable within seven days of court approval of acceptance. The attached homeowners association letter supports acceptance and says the association would bear no costs. The offer is conditional; the Sept. 3 authorization to begin the process is not the approval of acceptance described in the letter.
What happens next
Boyd said his office would proceed with notices, a hearing and property-owner ballots before a later court vote and assessments, under a process he identified as Chapter 253.003. His account describes the steps the county intends to take; the minutes record authorization to start them. Residents seeking the next decision can compare the county’s published notices and eventual court action with the Sept. 3 minutes and the developer’s payment terms.
